These Terms and Conditions form the basis of the rental contract between the owners of the ‘Villa’, which is 301 Troon Circle, Davenport, Fl33837, USA, and the ‘Client’. The ‘Owners’ are Mr Alwyn Roberts and Mrs Kim Roberts. Rental of the Villa is conditional upon the Client’s acceptance of the following Terms and Conditions.

1. Initial Booking

Provisional bookings via the telephone or confirmed by e-mail to the Client will be held for 7 days while the completed booking form and deposit are sent to the Owners.

Once the deposit has been paid and the booking form received, we will confirm the Client’s reservation for the agreed dates. The Villa is charged out as a unit and not per person, subject to a maximum occupancy of 10 people plus cots.

2. Deposit Payment.

A deposit payment of 25% of the Rental fee is payable upon booking.

3. Balance Payment

The balance of the rental fee, plus costs for any additional services requested, must be paid no later than 8 weeks prior to the commencement of the rental. If the balance is not received within that time, we reserve the right to treat the booking as cancelled, in which case the Client would be liable to pay the Owners for cancellation charges, detailed below.

(However, should we be able to re-let the Villa, we may, at our option, consider refunding the deposit, less any additional costs incurred.)

4. Security Deposit

A refundable Security Deposit of £150 (US$250) is required at the time of balance payment. This deposit will be refunded, less any costs incurred, such as accidental damage to the property or contents etc. or exceptional cleaning costs for example.

Payment can be made by cheque, which will not be cashed, unless additional costs are notified to us by the management company.

In the event of major damage, exceeding the value of the security deposit, we reserve the right to submit additional invoices or take appropriate legal action to recover additional costs.

We would request that guests refrain from smoking inside.

5. Amendments to the Booking

Changes to the booking details will be accepted up to 8 weeks prior to commencement of the rental date, subject to availability of the property. Date changes within the 8 weeks prior to the rental period may be treated as a cancellation, and could result in a cancellation charge being applied as outlined in paragraph 6 below.

However, subject to availability and demand, we will, where possible, endeavour to accommodate all reasonable requests.

6. Cancellation

All cancellations must be made in writing by the Client who signed the booking form. Cancellation charges will be charged as outlined below:

7. If the Client has any Problems or Complaints

We will endeavour to ensure, in conjunction with the 24-hour on-call management company, that you will have an enjoyable and trouble-free stay at the Villa.

In the unlikely event of any problems occurring, or the Client having a complaint, the Client must notify the Owners’ local management company at the earliest opportunity, in order that they may take the appropriate steps to rectify the situation. If the problem is not resolved whilst at the Villa, please write to us with 14 days of departure from the Villa.

8. Your Rental Reservation

Upon receipt of the completed booking form and full deposit, the dates for the rental will be confirmed. On receipt of full payment within the timescales set out above, we will then send a booking confirmation number together with further information on what to do to gain access to the villa when the booking commences.

9. Price Guarantee

We guarantee that the agreed rental price will not change once the deposit has been paid and the booking confirmation has been received. Prior to this time we reserve the right to change the rental price at our discretion, as compared with any published or advertised price.

10. Cancellation of the Booking by the Owner

If the Villa becomes unavailable for any reason between the agreed dates, we will inform the Client as soon as reasonably possible. In the unlikely event of it no longer being possible for the Client to stay at the Villa (unless this is caused by Force Majeure - see below), we will, at the Client’s option provide a full refund of all monies paid to us, or if you wish, we will, through our local management company and other contacts, attempt to arrange alternative villa accommodation of a comparable standard and location. We make no guarantee, however, that we will be able to succeed in this.

11. Limitation of Liability

Neither we the owners nor our agents accept any liability whatsoever for death, personal injury, sickness, accident, delay or loss of luggage or personal effects, or any other loss or misadventure which may occur whilst renting the property. It is the responsibility of an adult member of the party to ensure that children are properly supervised at all times within the pool and surrounding area. No diving or horseplay in the pool. Glass is not permitted in the pool area. Use of the pool, the community pool, tennis courts and recreation area is entirely at your own risk. Please bear in mind that the villa is situated on a development which consists of both residential and vacation homes. Therefore, neither we the owners nor our agent can be held responsible for any ongoing construction, alterations to existing houses or any noise as a result thereof on or around the housing development. This waiver is also applicable to people visiting the property as guests of the client.

Although every effort is made to ensure that the villa is in perfect condition, neither we nor our agents can accept responsibility for any claims, accidents, damage to or loss of property or for any expenses incurred for any reason including changes caused by forces of nature nor can liability be accepted for injury as a result of the use of the villa or pool howsoever caused.

Please Note: All clients are strongly advised to have adequate travel / holiday / medical insurance in force for all members of the party for the entire period of rental.

12. Force Majeure

Neither we the owners nor our agents can accept responsibility or liability for any loss or damage or alteration to the terms of your reservation caused by events beyond our control, including, but not restricted, to war, terrorist activity, civil commotion, technical problems with transportation, flight delays or cancellations, airport closures, adverse weather conditions, fire, flood, industrial dispute or failure of public supplies.

13. Website and Brochure Descriptions

All descriptions given on the website and in the brochure are made in good faith, but no liability can be accepted for errors or omissions.

13. Behaviour

We expect all our clients to behave reasonably and responsibly and have due consideration for other people at all times. In the event of a client behaving in such a way as to cause or be likely to cause, in the opinion of our management company, danger, distress, annoyance to any part or damage to the property, we reserve the right to terminate your property let. In this situation, our responsibility for your holiday arrangements will immediately cease and we will not be responsible for meeting any costs or expenses you may incur as a result, paying any compensation or making any refunds. Clients should treat the property with respect and leave the home in a clean condition. Nothing should be allowed to interfere with the quiet or comfort of other residents.

14. Law

Signature of the booking form constitutes acceptance of a contract on these terms. The contract is governed by, and shall be interpreted in accordance with, English Law, and the parties hereto shall both submit to the jurisdiction of the English Courts.
